TIME FOR A FRESH START

Stop garnishments, collections, foreclosures 

The automatic stay typically goes into effect upon the filing of the bankruptcy.  The stay makes it illegal to attempt to collect from the debtor (the person who filed bankruptcy).   This gives you the the peace and quiet to get your feet under you, focus on what is important, and deal with all your creditors; not just the ones that yell and scream the loudest.

Bankruptcy is built on treating everyone fairly, both the person who filed, and the creditors.  Being aggressive, charging high interest rates, or just not liking the system doesn't make a creditor special, and doesn't give them the right to ignore federal law and your bankruptcy.

Chapter 7



Chapter 7 is what most people consider a "normal" bankruptcy; your assets and income are disclosed to the trustee, and if there are unprotected assets, a trustee might be able to sell them.  Then, a discharge is entered, making certain debts uncollectable.

Chapter 7s are quick, effective, and straightforward.  They are also dangerous - you don't want to be taken for a ride you didn't sign up for!  

Loan Modifications

New for 2016 the Northern District of California is adopting the Mortgage Modification Mediation (MMM) program.

Loan modifications are a great way to get caught up on late payments, adjust payments down to an affordable level, and save your house. 

This exciting program allows us to get a court-appointed mediator assigned to a loan modification, as well as a direct document submission portal to ensure a modification is judged on its merits.​

Chapter 13

A Chapter 13 is a simple reorganization, and has a lot more tools than a Chapter 7.  Behind on a mortgage?  Want to pay back taxes?  Have a car with an excessive interest rate, or even a title loan?  A Chapter 13 gives you the tools to deal with all of these, and more!

Chapter 13s are more complex than a Chapter 7 filing, but are often the best way to get the "fresh start" the law grants you.

However, a Chapter 13 involves a greater commitment than a Chapter 7; 36 to 60 months in most cases.

Taxes

Your taxes might be dischargeable in bankruptcy - made uncollectable.  

Income taxes that have aged long enough  can lose their "priority" and have the same rights as credit cards, medical bills, and payday loans.

Even if you have a tax lien, a bankruptcy might give you the opportunity to pay that lien off at a reduced amount, or remove it from your property.​
